Legal
The legal environment at the moment is not in line with the needs of Person with disability (PWDs) and their families. If they exist, they have not always been consistently applied.
In order to solve the obstacles to the life of people with disabilities and their parents (guardians), the Foundation will, in accordance with existing legislation, engage in the organization of:
- adaptation of apartments for people in wheelchairs,
- searching for and engaging construction companies in order to build a residential unit according to
principles of affordability and market conditions,
- employment of PWD parents,
- the formation of legal entities where parents with disabilities will have the possibility of employment,
- organizing economic activities within the Foundation where employment is possible
parents of PWDs, PWDs themselves, family members, as well as employment of the regular population.
Additional activity of the Foundation will be focused on providing direct suggestions and proposals aimed at improving specific laws, acts, regulations resulting from positive regulations, as well as at creating new solutions aimed at facilitating the functioning of parents of PWDs and identifying the problems they face.
It is important to note:
- At the moment, the National Employment Service does not have the "Parent of PWD" option.
- The Law on Personal Income Tax does not have the option to work less than 40 hours a week, which has the consequence that the payment of wages for the population of PWD parents is more expensive from the aspect of the Employer, because a parent can usually work 3 to 5 hours a day. This working time is not conditioned by the working capacity of the parents, but by its impossibility for the PWD to be taken care of somewhere for 8 or more hours a day.
In its work, the Foundation is obliged to comply with legal regulations that prevent discrimination against persons with disabilities and to comply with the Law on Personal Data Protection as well as the General EU Regulation.
